The Legal Part
Terms & Conditions
These terms govern participation in the MA! Architecture Tour. Year-specific dates, deadlines, and fees are published in the Annual Program Schedule for each edition. By submitting an entry, participants agree to these terms in full.
Submission Requirements
Only exemplary contemporary residential and commercial projects will be selected for the MA! Architecture Tour. MA! determines eligibility at its sole discretion.
Submissions must include:
- 4 to 6 high-resolution professional-grade images (minimum 300dpi, 4MB per image) covering both exterior and interior spaces.
- A project description of 300 to 500 words.
- Written approval from the property owner or appropriate authority. Where the submitting party is not the owner, a separate written authorisation must be provided.
- Proof of current liability insurance. For speculative properties, proof of builders risk or equivalent coverage is required.
Projects must be structurally complete and furnished at the time of submission. Unfurnished properties may be considered at MA!’s discretion — staging options are available at additional cost. Contact elayne@ma-designishuman.com. An in-person walk-through may be requested. Projects must be clean and ready for public access during the tour.
All participants must hold, or ensure the property owner holds, a minimum of $1,000,000 general liability coverage for the tour period. Evidence of coverage must be provided to MA! no later than 30 days before the tour begins.
MA! Responsibilities
MA! agrees to:
- Promote the tour through press, digital, and print channels.
- Produce a tour brochure, general map, and visitor guide featuring submitted projects.
- Manage visitor flow through each project, providing a minimum of four volunteers or docents per project per tour day.
- Host a press and attendee event to launch the tour.
MA! will use reasonable endeavours to protect properties and persons during the tour but accepts no liability for damages or losses to property or persons, except where directly caused by MA!’s gross negligence or wilful misconduct. Children under 8 are not permitted to attend.
Cancellation Policy
The cancellation deadline for each edition is published in the Annual Program Schedule. Cancellations must be submitted in writing to elayne@ma-designishuman.com.
- Cancellations before the deadline: no fee applies.
- Cancellations after the deadline: a fee of $500 applies to cover sunk printing, marketing, and communication costs. MA! may waive this in exceptional circumstances.
If MA! cancels the tour due to circumstances beyond its reasonable control — including acts of God, extreme weather, pandemic, civil unrest, or government restriction — no cancellation fee will apply to participants.
Commercial Activity and Third-Party Participation
Participation in the tour may not be used to advertise, promote, or distribute materials for any commercial product or service without MA!’s prior written approval. This includes but is not limited to: furniture, home products, appliances, technology, landscaping, contractor services, design services, showrooms, retailers, and distributors.
Where a third party wishes to promote themselves in connection with the tour, the participant must notify MA! in advance with the relevant name and contact details. MA! will contact that party directly to discuss participation options. Failure to notify MA! may result in additional fees or penalties applied to the third party.
Participants may share their involvement on their own social media channels from the date MA! publicly announces the project list. Posts must credit MA! Architecture Tour and must not imply sponsorship or commercial endorsement of any product or service by MA!. Participants may not publish images of other tour projects without consent from the relevant architect or owner.

Copyright and Photography
By submitting materials, the participant grants MA! a non-exclusive, royalty-free, worldwide licence to use submitted images and copy in connection with MA! Architecture Tour promotion, marketing, advertising, events, and exhibitions, without time restriction. This includes print media and digital or electronic media, including MA!’s website and social platforms.
MA! will use submitted photographs in low resolution where technically feasible. Where provided, photographer credits will be applied in line with standard media practice. This licence does not transfer ownership of copyright. MA! will not sublicense or transfer submitted materials to unrelated third parties without the participant’s prior written consent.
Indemnification and Liability
The participant agrees to indemnify and hold harmless MA!, its officers, employees, volunteers, and agents from any claims, damages, losses, or expenses arising from: breach of these terms; inaccuracy in submitted materials including third-party intellectual property infringement; the condition or accessibility of the project during the tour; or any act or omission of the participant or their contractors in connection with the tour.
MA!’s total liability to the participant will not exceed the total fees paid by the participant for the relevant tour edition. MA! will not be liable for indirect, consequential, or speculative losses.
General
These terms are governed by the laws of the State of Georgia, United States. In the event of a dispute, the parties agree to first attempt resolution through good faith negotiation. If unresolved within 30 days, the parties agree to engage a mutually agreed mediator before initiating formal legal proceedings.
These terms, together with the relevant Annual Program Schedule, constitute the entire agreement between the parties in relation to the participant’s involvement in the tour. If any provision is found to be unenforceable, the remaining provisions continue in full force. MA! reserves the right to update these terms between editions; the version in force at the time of submission governs.
Speculative “Spec” Projects
Each year MA! Architecture Tour attracts thousands of visitors eager to experience contemporary architecture and design at its finest. Many are interested in building or buying their own modern dream home for the first time. The tour becomes a valuable resource to information and making connections—including visiting modern speculative projects or ‘spec house’ carefully curated for the tour. Speculative builders value the tour’s appeal as a magnet attracting visitors to bold architecture— and buyer to seller.
MA! recognizes the spec house is a speculative venture, meaning it is purpose-built with the sole intention of selling it for a profit—as-is or with minimal changes. Additionally, some homes may not be occupied and are already “owned” by a developer or realtor with plans to sell the property at some point.
For this reason and in fairness, MA! Architecture Tour charges a modest fee of $2500 prior to the project being placed on the tour.
Projects that are for sale can be promoted during tour with the following:
– signage outside the home
– realtor/seller business cards and sales flyers discreetly placed in one area of the home
MA! discourages direct selling of the project during Tour hours in deference to Tour attendees.
NOTE: all speculative or unoccupied homes MUST be fully furnished (all rooms must have furniture and accompanying accessories) for the Tour. If required, MA! will provide an approved list of furniture showrooms and manufacturers who are willing to provide product for staging. Some fees may apply.
